FIREARM CONSIGNMENT AGREEMENT
Terms and Conditions for TMVS Firearms Consignment
Consignor agrees to place the items listed below on consignment with TMVS Firearms, to try to sell them under the terms of this agreement.
TMVS Firearms agrees to accept the items listed for consignment sale under the terms of this agreement.
The Consignor represents that they are the rightful owner of the items listed, and that the items are free of any encumbrance. While this agreement is in effect, Consignor agrees to grant the exclusive right to TMVS Firearms to market, advertise and sell the item(s) listed below.
TMVS Firearms will inspect and service all the items listed in this agreement and will determine condition and functionality.
TMVS Firearms will write up the description and specifications necessary in order to offer the items for sale. TMVS Firearms will offer the items for sale at its retail location, at suitable trade shows, internet auctions, etc.
The consignment fee shall be 10% of the selling price of the item, with a minimum fee of $35 per item.
Fees for other services provided by TMVS Firearms, (e.g. cleaning, repair) or for services provided by third‐party vendors (e.g. auction listing fees, credit card fees, packing and shipping fees, etc.) are additional and are not included in the consignment fee.
When the items consigned are sold and final payment is made by the buyer, all applicable fees and expenses are deducted from selling price and the Consignor will receive the net amount within 30 days via business check. If consignor does not pick up check within 14 days, the check will be mailed to their address of record on file via U.S.P.S.
The Consignor agrees that, as TMVS Firearms is required to complete all inspections and specifications, prepare the items for sale, and advertise the items, that the items consigned will be left on consignment with TMVS Firearms for a minimum of sixty (60) days.
This agreement will continue indefinitely beyond the original 60-day period unless either party notifies the other of their intent to terminate it. Because a sale may be pending, or an advertisement just placed; the Consignor agrees to give thirty (30) days’ notice if the Consignor wishes to have items covered by this agreement returned.
If the Consignor decides to have consigned item(s) returned, Federal Law requires that the Consignor complete all appropriate forms as if they were purchasing the firearms and pass the NICS background check. Consignor agrees to pay TMVS Firearms any out of pocket expense incurred.
If consignor is unable to pass the NICS check, they will have 10 business days to solve the issue. If the issue cannot be resolved, the firearm becomes the permanent property of TMVS Firearms.
LIABILITY
Consignee shall not be liable to Consignor for any loss or damage suffered to Consignor's merchandise, including, but not limited to, loss or damage to such merchandise from fire, theft, or other casualty.
Consignor hereby fully releases Consignee possible under the law from any and all claims or any nature in connection with or arising from the placement of Consignor's merchandise with Consignee.
Consignor further covenants that he/she shall make no claim against Consignee, Consignee’s insurance carrier or the property owner where the items are being stored or held for any damage to Consignor’s merchandise.
